How do I file a claim?

In the rare event of loss or damage to your shipment, the following procedures must be followed in order to ensure your claim is effectively processed:

SUBMIT ALL CLAIMS TO:
Totalline Transport
Claims Department
155 Delta Park Blvd.
Brampton, ON L6T 5M8
Phone: (905) 792-9797
Fax: (905) 792-9082

  • All claims or intent to claim must be made in writing to Totalline Transport at the above address and/or fax number and must be submitted within 60 days.
  • The following documents must accompany the claim:    a. Original supplier's invoice showing the value of the shipment (cost of goods value, not the retail value)
       b. Original bill of lading
       c. Final proof of delivery
       d. Itemized invoice outlining loss or damage to the shipment
       e. Copy of the original freight bill
       f. Inspection report or description of damage if an inspection was waived.
  • Damages or shortages must be explicitly noted on the carrier's proof of delivery when such delivery is made. The following notations are not acceptable and will not entitle you to file a claim:    a. Subject to inspection
       b. Possible shortage
       c. Possible damage
  • Concealed damage claims must be reported immediately to Totalline Transport. When concealed damage is noted, stop unpacking, notify the carrier without delay and request an inspection. Continued unpacking of the shipment could disqualify your claim. Packaging must be retained for inspection by the carrier.
  • The time limit for filing a claim is up to 9 months, but is only valid providing that intent has been filed within 60 days.
  • Valuation clauses:
      a. A carrier's liability is restricted to $2.00 / lb. when no value is declared on the bill of lading at the time of shipping.
       b. When a declared value is shown and purchased at an additional cost of 1% for insurance in excess of $2.00 per pound, Totalline is liable for an amount up to, but not exceeding, the value declared. Pertinent invoices are required to verify the value of the goods.
  • A carrier is liable only for the value of the goods at time of shipping. A carrier is not liable for overhead expenses, lost profits, administration fees, etc.
  • Shipments must be checked according to the carrier's pro bill and not the packing slip.
  • Carriers are not liable for goods shipped at "Owners Risk of Damages" or for goods not properly crated or packaged. This type of claim should be filed with your supplier.
  • Salvage on damaged goods must be retained by the customer as well as the packaging.
  • In the event that the claim is paid, the salvage and packaging will then be given to the carrier.
